Terms of Use

These terms are the agreement between you and Agonist Ltd. Şti. (“GuideField”, “we”) for the GuideField apps, website and services. Please read them together with our Privacy Policy.

1. Acceptance and eligibility

By creating an account or using GuideField you accept these terms. You must be at least 18 and act for yourself or for the company you represent; if you register on behalf of a company you confirm you may bind it. GuideField is built for professional guides and tour operators.

2. Accounts and verification

Keep your credentials secret and tell us at once if you suspect misuse; you are responsible for activity under your account. Guides are verified with a verification code issued by GuideField or a tour company, or by two verified colleagues who vouch for them; operators are verified with company documents. You promise that what you give us is accurate and that you hold the licences and permits your activity requires under the law of the place where you work. Verification is a convenience check by GuideField, not an official check of any guiding licence or identity card and not a certification or endorsement of anyone, and you remain solely responsible for compliance with tourism, guiding, travel-agency, employment and tax rules.

3. Your content and the licence you give us

You keep all rights in what you create (messages, pins, photos, voice notes, routes, notes). You give GuideField a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, reformat and transmit that content, and to show it to the people you chose, only as needed to run and improve the service. For content you make public, other verified users may view it in the app. The licence ends when you delete the content or your account, except for copies in routine backups for a limited time and content other users have lawfully copied under their own route-sharing rights.

You promise that you have the rights to everything you upload, that it does not infringe anyone’s copyright, privacy or other rights, and that you have the consent of any identifiable person in your photos or recordings and of any guest whose data you enter.

5. Moderation, reports and notices

You can report or block content and users inside the app. We review reports and may remove content, restrict features or suspend accounts that break these terms or the law, and we may preserve and hand over data where legally required. Where we remove content or restrict an account we will, where the law requires, tell you why and let you object.

To report unlawful content or an infringement outside the app, email info@agonistdigital.com with: where the content is, what right or law it breaks, who you are, a statement that your notice is accurate and made in good faith, and for copyright claims the work concerned and your authority to act. Repeat infringers will be removed. This address is also our single point of contact for authorities and users under EU Regulation 2022/2065 (Digital Services Act) and for Turkish Law No. 5651 notifications.

6. Credits and payments

GuideField does not run a marketplace and does not take payments between users. If a guide agrees to sell a tour or route to a tour company, that is an arrangement entirely outside GuideField: we are not a party, take no commission and are not responsible for it.

Live tours beyond the free allowance use credits that you buy through the App Store or Google Play. Credits are a limited, personal licence to use the paid feature, have no cash value, cannot be transferred, sold or redeemed for money and are tied to your account. Prices, taxes, billing and refunds follow Apple’s or Google’s purchase terms; you may have statutory rights (including withdrawal rights that may end once digital content is delivered with your consent), which these terms do not limit. If your account is deleted or closed for your breach, unused credits are lost.

7. Safety and emergencies

GuideField is not an emergency service. Location-locked notes, map data and routes are aids; their accuracy, completeness and safety are not guaranteed, conditions change and you must use your own judgement and local knowledge. In an emergency call the local emergency number (112 in Turkey and the EU) first, never rely on the app, and never rely on someone else’s note to decide whether a place is open, permitted or safe.

8. Third-party data and services

GuideField uses map data © OpenStreetMap contributors (ODbL), text from Wikipedia and data from Wikidata, photos from Wikimedia Commons contributors under their licences, Apple Maps and Google Maps. Attributions and licence terms are on the Credits page and in the app under Profile, Legal. Third-party services are subject to their own terms. Apple and Google are not parties to these terms, have no obligation to support the app and, as third-party beneficiaries, may enforce these terms against you where their store rules say so.

9. Our intellectual property

The app, name, logo, design and platform content (other than yours and third parties’) belong to GuideField or its licensors and are protected by law. We give you a personal, revocable, non-transferable licence to use the app under these terms. Open-source components remain under their own licences listed in the app. “GuideField” and the logo may not be used without our written permission. Feedback you send may be used by us without obligation.

10. Availability and changes to the service

The service is provided “as is” and “as available” and may be interrupted for maintenance, beta changes or reasons beyond our control. We may change or discontinue features; where a change materially harms paying users we will give reasonable notice.

11. Liability

To the extent the law allows, GuideField is not liable for indirect or consequential loss, lost profits or business, data loss, the content or conduct of users, or events during tours, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose or, if you paid nothing, to TRY 1,000. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, personal injury or death, or any mandatory consumer right.

You will compensate GuideField for third-party claims and losses arising from your content, your breach of these terms or your breach of law.

12. Suspension and termination

You can stop using GuideField and delete your account in the app at any time (Profile, My Profile, Delete My Account). We may suspend or end accounts that break these terms or the law, with notice where reasonable. Sections that by their nature should survive (content licences for lawful copies, liability, disputes) survive termination.

13. Changes to these terms

We may update these terms. For material changes we will notify you in the app at least 30 days before they apply; if you keep using GuideField afterwards you accept them, and if you do not agree you can delete your account.

14. Governing law and disputes

These terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. The courts and enforcement offices of Ankara have exclusive jurisdiction, unless you are a consumer who may bring a claim in the courts of your place of residence under mandatory law. Please contact us first at info@agonistdigital.com and we will try in good faith to resolve any complaint.

15. General

If a provision is invalid the rest stays in force. Our not enforcing a right is not a waiver. You may not assign these terms without our consent; we may assign them to a successor of the business. These terms and the Privacy Policy are the entire agreement on this subject. The English text is the original; a translation is for convenience. Contact: Agonist Ltd.
